About California Senate Bill (SB) 43

SB 43 expands California's definition of "grave disability" for the purposes of involuntary psychiatric holds and conservatorships. A person may qualify for an involuntary hold if the have a severe mental health disorder, a severe substance use disorder(SUD), or a co-occurring mental health disorder and severe SUD, and as a result are unable to provide for their basic needs of food, clothing, shelter, personal safety or necessary medical care.

This expansion allows intervention when someone's mental health disorder or substance use disorder puts them at serious risk, with the goal of connecting individuals to treatment and stabilization rather than criminalization. 

Yolo County is implementing SB 43 effective Jan 1, 2026

Local law enforcement and hospitals are being trained on the new information.

This new definition applies to the three primary LPS Act processes:

  • Crisis Intervention: Assessment, evaluation and crisis intervention or placement in an LPS-designated facility for evaluation and treatment for up to 72 hours (W&I Code § 5150)
  • Intensive Treatment: Up to 14 days (W&I Code § 5250); if necessary and appropriately authorized, the intensive treatment period for grave disability may be extended for up to two periods of 30 days each (W&I Code § 5270.15, 5270.70).
  • Conservatorship: Up to one year, with the option to petition for reappointment, for ongoing behavioral health treatment and support (W&I Code § 5350, et seq.)
